I am totally confused by this meaning "to divest oneself". Does this mean then that although under police interview a person may state yes i downloaded them, but at trial its proven they have been deleted and can only be retrieved by forensic means that you are not then in possesion, that you can still be charged. Surely a lesser sentance would then be imposed or the case quashed?

Does this mean then, that even if you admit that you have downloaded them, but since deleted them, that you are still accountable for possesion. Also if the files cannot be retrieved apart from professional means will this reflect on the length of sentance given?
